Mixyt is a platform for intentional music curation and storytelling using embedded YouTube content. To protect the community and the service, the following fundamentals apply:
These Terms of Service ("Terms") constitute a legally binding agreement between you and Mixyt ("we," "us," or "our") concerning your access to and use of the Mixyt web application and services. By registering for an account, accessing, or using Mixyt in any way, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you are prohibited from using the platform.
No Media Hosting: Mixyt is a curation, organization, and editorial indexing tool. Mixyt does not host, upload, download, store, stream, or duplicate third-party audio or video files on its servers. All audio/visual playback on Mixyt is powered exclusively through standard YouTube embedded players and YouTube API Services.
No Copyright Claims Over Embedded Media: Mixyt claims zero copyright, ownership, or intellectual property rights over any third-party music, videos, sound recordings, album artwork, lyrics, or artist trademarks displayed or played via YouTube embeds. All rights, title, and interest in such media remain the exclusive property of their respective copyright holders, artists, record labels, and YouTube uploaders.
Trademark Notice & Non-Affiliation: YouTube™ is a registered trademark of Google LLC. Mixyt is an independent curation platform and is not affiliated with, authorized by, sponsored by, or endorsed by Google LLC or YouTube LLC.
YouTube Terms of Service Compliance: By utilizing Mixyt to discover, listen to, or embed YouTube videos, you explicitly agree to be bound by the YouTube Terms of Service and the Google Privacy Policy.
Content Availability & External Changes: Because video streams originate from YouTube, Mixyt cannot guarantee that any video will remain playable. Videos may be removed, deleted, set to private, geo-blocked, or restricted by the original uploader or YouTube at any time. Mixyt is not responsible or liable for any unavailable, removed, altered, or restricted videos.
To create playlists, participate in monthly themes, or collaborate with other curators, you must create an account. You represent and warrant that:
You are entirely responsible for all text, titles, commentary, descriptions, tags, challenge messages, and links you post to Mixyt ("User Content"). You expressly agree not to use Mixyt to:
🚫 Harass, Bully, or Threaten: Engage in harassment, hate speech, bullying, stalking, defamation, intimidation, discrimination, or abusive conduct targeted toward any individual, creator, curator, or group.
🚫 Illegal or Harmful Content: Submit links or commentary containing unlawful, sexually explicit, defamatory, fraudulent, violent, or predatory material.
🚫 Spam & Commercial Abuse: Post unauthorized advertising, promotional affiliate spam, pyramid schemes, or unsolicited commercial messages through playlist titles, notes, or challenges.
🚫 Impersonation: Impersonate another person, curator, musical artist, entity, or Mixyt administrator.
🚫 System Interference: Introduce viruses, worms, automated scrapers, crawlers, DDoS attacks, or attempt to reverse-engineer, exploit, or disrupt Mixyt's software and database integrity.
Absolute Right to Terminate: Mixyt reserves the unilateral and unconditional right, at its sole discretion and without prior notice, liability, or refund, to:
You retain ownership of your original written prose, reviews, commentary, and playlist titles. However, by publishing public playlists, themes, or commentary on Mixyt, you grant Mixyt a worldwide, non-exclusive, royalty-free, perpetual license to host, display, index, format, and share your user-submitted metadata across the platform in connection with providing the curation service.
Software & Productivity Tooling: Mixyt may offer optional paid subscriptions, premium memberships, or creator tiers. Any fees charged by Mixyt are strictly for software functionality, editorial publishing capabilities, playlist capacity extensions, collaboration permissions, analytics, and platform infrastructure.
No Sale or Paywalling of Third-Party Media: Mixyt does not sell, license, or gate access to third-party audiovisual works or sound recordings. Embedded YouTube content remains free and accessible to all users through YouTube's official players in accordance with YouTube API Services Developer Policies.
Mixyt respects intellectual property rights. Since video streams originate directly from YouTube, copyright owners seeking to take down a video should submit a DMCA request directly to YouTube. For inquiries or takedown requests regarding text descriptions or user-submitted metadata hosted directly on Mixyt, copyright holders may contact us at dmca@mixyt.io with:
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. MIXYT AND ITS OPERATORS EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, SERVICE CONTINUITY, UPTIME, FREEDOM FROM BUGS OR ERRORS, OR ACCURACY OF CONTENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MIXYT, ITS CREATORS, OPERATORS, OWNERS, CONTRIBUTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, WORK STOPPAGE, OR COMPUTER MALFUNCTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
UNDER NO CIRCUMSTANCES SHALL MIXYT'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF FIFTY US DOLLARS ($50.00 USD) OR THE TOTAL AMOUNT YOU PAID TO MIXYT (IF ANY) IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to defend, indemnify, and hold harmless Mixyt, its operators, contributors, affiliates, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of and access to Mixyt; (b) your violation of any provision of these Terms; (c) your violation of any third-party right, including copyright, trademark, privacy, or publicity rights; or (d) any claim that your User Content caused damage to a third party.
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide reasonable notice on our site. Your continued use of Mixyt after any revisions become effective constitutes your acceptance of the new terms.
